Posse Comitatus Repealed
Since 1872, each able-bodied person 18 years of age or older was required to aid and assist law enforcement in making an arrest, retaking into custody an escapee, or preventing the commission of a crime. Failure to do so at the command of a police officer could result in criminal punishment. With the enactment of SB 192 and starting January 1, 2020, the able-bodied adult is no longer required to assist law enforcement. While this may be a disappointment to some who stood at the ready, many believe the change in the law is necessary given the changes in society and modern-day law enforcement.
