CHANGES IN THE DUI LAW FOR 2014
The most significant change in the driving under the influence (DUI) laws for 2014 is a reorganization of the statute. While the elements of DUI/DWI have not changed, the legislature separated offenses involving alcohol, drugs and the combination of both.
Previously, Vehicle Code Section 23152(a) made it illegal to drive under the influence of alcohol or a drug, or under the combined influence of any alcoholic beverage and drug. The statute now separates these acts into three distinct offenses:
(a) It is unlawful for a person who is under the influence of any alcoholic beverage to drive a vehicle.
(e) It is unlawful for a person who is under the influence of any drug to drive a vehicle.
(f) It is unlawful for a person who is under the combined influence of any alcoholic beverage and drug to drive a vehicle.
(California Vehicle Code Sections 23152(a), (e) and (f))
The legislature should be commended for making the statute clearer to limit unintentional consequences.
