SB 530 is amongst the many bills passed in the new year which improve post-conviction relief for those who have suffered a criminal conviction. This new law, codified in Penal Code Section 4852.22, speeds up the opportunity for the court to grant a certificate of rehabilitation.
Unlike those eligible for expungements under Penal Code Section 1203.4, individuals who suffered a prison commitment would previously have to wait a minimum of five years before seeking a certificate of rehabilitation. Penal Code Section 4852.22 now authorizes the court to grant such relief earlier in the interest of justice. This law does not apply to sex offenses.
